1. Introduction

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and Vitali Stsiapanau ("Developer" or "we") regarding your use of the Block Color - Coloring Book 3D mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not use the App.
This agreement is solely between you and the Developer and not with Apple Inc. Apple is not responsible for the App or its content.

2. License Grant

he Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with the terms of this EULA.

3. Restrictions

You agree not to:

• Reproduce, distribute, or modify the App;

• Reverse engineer, decompile, or disassemble the App;

• Use the App in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with this EULA;

• Rent, lease, lend, sell, redistribute, or sublicense the App;

• Use the App in any way that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the App.

  
  

4. Ownership

All rights, title, and interest in and to the App, including but not limited to content, graphics, user interfaces, and software code, are owned by the Developer. This EULA does not grant you any ownership rights to the App.

5. Privacy

Your use of the App is subject to the Developer’s Privacy Policy, which is available within the App and on our website.

6. Termination

This EULA is effective until terminated by either you or the Developer. Your rights under this EULA will terminate automatically if you fail to comply with any term(s) of this EULA. Upon termination, you must cease all use of the App and delete all copies of the App from your device.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The Developer does not warrant that the App will be uninterrupted or error-free.

8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall the Developer or Apple be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your access to or use of the App. The Developer is solely responsible for any product warranties, whether express or implied by law. Apple is not responsible for any claims, losses, liabilities, damages, or costs related to your use of the App.

9. Governing Law and Your Jurisdiction

This EULA shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles. You agree to submit to the jurisdiction of the courts located within Estonia for the resolution of any disputes arising out of or related to this EULA.

10. Amendments

The Developer reserves the right to modify this EULA at any time. Any changes will be posted within the App or on our website. Your continued use of the App after such changes constitutes your acceptance of the new EULA.

11. Third-Party Beneficiary (Apple Clause)

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of the terms of this agreement, Apple shall have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
